Pretty much brand new, unfortunately I don't think it has Mario kart on it. It has a new sd card and I don't think it's on there. But this is an amazing handheld, and it comes with the box and purchases charger (in third picture). The 3ds is in amazing condition, no flaws, works perfectly.
